By downloading, installing, or using the NH Ski Map mobile application ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App. The license granted to you is non-transferable and is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
NH Ski Map is an informational guidebook application that provides locations and descriptions of backcountry ski routes in New Hampshire. The App is intended to show you where skiing routes exist — it is not intended to advise you on whether you should ski any particular route.
Backcountry skiing is an inherently dangerous activity. By using this App, you acknowledge and accept that you assume all risks associated with backcountry skiing, including but not limited to avalanches, falls, changing weather conditions, equipment failure, and injury or death.
You are solely responsible for evaluating trail conditions, your own skill level, weather, avalanche danger, and any other factors relevant to your safety before undertaking any route. The App does not provide real-time conditions, safety assessments, or recommendations on whether any route is safe to ski.
While we strive to provide accurate and up-to-date route information, we make no guarantees regarding the accuracy, completeness, or reliability of any content in the App. Route descriptions, maps, coordinates, and other details may contain errors or may become outdated. Trail conditions, access points, and terrain can change at any time without notice.
The App and all content are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of Red Beard Technologies LLC.
To the fullest extent permitted by applicable law, Red Beard Technologies LLC and its owner, operators, and contributors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to personal injury, property damage, or death, regardless of the cause of action or the theory of liability, even if we have been advised of the possibility of such damages.
All content, design, graphics, and other intellectual property in the App are owned by Red Beard Technologies LLC or its licensors. You may not reproduce, distribute, or create derivative works from this content without prior written permission. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Red Beard Technologies LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to misuse the App or attempt to access it through unauthorized means.
We reserve the right to suspend or terminate your access to the App at any time, for any reason, without prior notice.
We may update these Terms of Service from time to time. Continued use of the App after changes are posted constitutes your acceptance of the revised terms.
These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law provisions.
The following additional terms apply when you download or use the App through the Apple App Store.
This End-User License Agreement ("EULA") is between you and Red Beard Technologies LLC only, and not with Apple Inc. ("Apple"). Red Beard Technologies LLC, not Apple, is solely responsible for the App and its content. This EULA may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions as of the date you accept this EULA.
Red Beard Technologies LLC is solely responsible for providing any maintenance and support services with respect to the App, as specified in this EULA or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
Red Beard Technologies LLC, not Apple, is responsible for addressing any user or third-party claims relating to the App or the user's possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).
Apple and its subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
